This application for anticipatory bail arises out of Nardiganj P.S. Case No. 163 of 2018, disclosing offences under Sections 341, 323, 308, 379, 504, 506 and 34 of the Indian Penal Code.

Learned counsel, appearing on behalf of the petitioners, has submitted that there is allegation against one Bipin Yadav of assaulting the informant with khanti. As against petitioner no. 2, it is alleged that he put his pistol on the temple of the informant. It is also alleged that some amount was snatched. Petitioner no. 3 is said to have given a lathi blow. Learned counsel for the petitioners has submitted that

Patna High Court Cr.Misc. No.73199 of 2018(2) dt.19-12-2018 2/2 only one injury has been found on the person of the informant, which can be attributed to the co-accused Bipin Yadav. On perusal of the first information report, I find substance in the submission made on behalf of the petitioners, this application is allowed. Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned C.J.M., Nawda in Nardiganj P.S. Case No. 163 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
