2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 8/23 (c) and 20 (B) (II) ( C) of the NDPS Act.

3. The case of the prosecution is that at the IndoNepal boarder, the boarder police noticed certain miscreants were coming towards Nepal carrying sacks on their heads. It is alleged that one of them was apprehended and disclosed his name as Pappu Paswan while the remaining persons managed to flee away. Upon interrogation, the apprehended person disclosed the name of the present petitioner and other co-accused persons, who had escaped. It is alleged that from the said sacks, altogether 77.5 K.G. 'Ganja' like substance were recovered.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that name of the petitioner has surfaced on the basis of the confessional statement of co-accused, Pappu Paswan and that nothing has been recovered from the conscious possession of this petitioner. Moreover, the petitioner is languishing in judicial custody since 31.07.2025 having one case under his belt.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection Mahuwa P.S. Case No. 10 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Special Judge, East Champaran, Motihari.
