Patna High Court CWJC No.24408 of 2019(2) dt.23-01-2023 2/3 "(i) Quashing of the Seizure Memo dated 06.11.2019 pertaining to DRI, Patna Unit Case No. 14/2019 - 20 (Annexure 3) by which, 18000 Kgs of Chuhara (Dry dates) valued at Rs. 27 Lacs and Ashok Leyland Truck bearing Registration No. RJ 23GA/ 4272 has been seized under Section 110 of the Customs Act for alleged violation of Section 7,11, 46 and 47 of the Customs Act, 1962;
(ii) Provisional release of the Chuhara (Dry Dates) which are perishable in nature weighing 18000 Kgs. and Ashok Leyland Truck bearing Registration No. RJ 23GA/ 4272 during the pendency of the present Writ application; and (iii) Restraining the Respondents from taking any coercive action against the petitioners, in connection with DRI Patna Unit Case No. 14/2019-20 during the pendency of the present writ petition."
After the matter was heard for some time, learned counsel for the petitioners, under instructions, seeks permission to withdraw the present petition reserving liberty to file a fresh petition, on the same and subsequent cause of action, furnishing better particulars and additional materials, if so required and desired.
Permission granted with liberty as prayed for. As and when any such petition is filed, the same shall be processed and listed on priority basis. Instant petition stands dismissed as withdrawn in
