The petitioners seek bail in Complaint Case No. 213 (O)/2019 arising out of CIS (Excise)- 1198 of 2019 registered for offence punishable under Section 30 (a) of Bihar Prohibition & Excise Act, 2018.

As per allegation, 19.800 liters of liquor were recovered from a Bus. However, counsel for the petitioners submits that they were merely a passenger of the Bus and nothing has been recovered from their possession. It is urged that the petitioners are in custody since 5.11.2019. It is claimed that their antecedents are clean.

No.78970 of 2019(2) dt.04-12-2019 2/2 Considering the facts and circumstances of the case, the petitioners, above-named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Judge, Excise Act, Buxar in connection with Complaint Case No.213 (O)/2019 (CIS-Excise-1198/2019) with a condition that if the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
