JUSTICE MADHURESH PRASAD ORAL ORDER 13-01-2020 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under sections 30(a) and 34(a) of Bihar Prohibition & Excise (Amendment) Act, 2016.

It is alleged that in the house of co-accused Bindeshwar Sahni, some liquor was being illegally manufactured. He has disclosed names of the petitioner along with other 11 persons to be engaged in manufacturing and selling liquor with him. It is on such allegation made by co-accused, that petitioner has been arrested in this case.

Petitioner is in custody since 16.10.2019 but it has wrongly been mentioned as 27.01.2019 due to typographical error in para 13 of the present petition. He is also accused in Keoti P.S. Case no. 39/2019.

Patna High Court CR. MISC. No.81411 of 2019(3) dt.13-01-2020 2/2 Submission is of false implication and that no recovery has been made from the petitioner to connect him with the present case.

Considering the aforesaid submissions, prayer for bail is allowed.

Let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Darbhanga in GO case no.100/2019 arising out of Sadar P.S. Case no. 29/2019 subject to the following conditions.

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
