Petitioner is apprehending arrest in connection with Saur Bazar PS Case No. 302 of 2016 for the alleged offence under Sections 409, 420, 467, 468, 471, 120B of the Indian Penal Code.
Allegation against the petitioner in the instant case is that in connection with verification of the folder file and certificate of the teachers necessary document was not furnished by the petitioner in spite of direction of the District Education Officer and has given benefit to the teachers who were appointed on the basis of forged certificates. Learned counsel representing the petitioner submits with reference to Annexure-4 that necessary document and the folder have already been deposited. He also submits that

Considering the aforesaid, this application is allowed. In the event of arrest or surrender before the concerned court below within a period of one month from today, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in connection with Sour Bazar PS Case No. 302 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and subject to the verification of the court below that necessary folder has been submitted by the petitioner for appropriate action by the District Education Officer, Saharsa.
