JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2020 Earlier prayer for bail of the petitioner was rejected twice by this Court firstly by order dated 14.9.2018 passed in Cr.Misc.No. 46414 of 2018 and secondly by order dated 27.6.2019 passed in Cr.Misc.No. 38947 of 2019 and allegation against the petitioner is of indiscriminate firing and causing injuries to father and uncle of the informant. Submission of learned counsel for the petitioner is that there was observation to renew prayer for bail after framing of charge in the court below, who will pass reasoned and speaking order after considering the materials available on record.

However, it seems that learned court below has rejected the petition on the ground that this is a serious matter of double murder and without discussing the materials available on

Patna High Court CR. MISC. No.77722 of 2019(2) dt.05-02-2020 2/2 the record against the petitioner.

In such view of the matter, this application is disposed of with direction to the petitioner to pray for bail before the court below, who will consider materials available in the case diary and after discussing the same the court will pass an appropriate order.
