JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-12-2018 The petitioner seeks regular bail in connection with Salimpur P.S. Case No. 71 of 2018, registered for offences punishable under Sections 25 (1-b)a, 26 and 35 of the Arms Act. Allegation as per F.I.R. is that police on information that accused persons of murder of a person have assembled at Surbhi Hotel near Telpar road and on which police raided the place and arrested 5 accused persons and from the possession of the petitioner one loaded country made pistol with live cartridges was recovered. Further it appears that the petitioner is accused in two more cases.
Submission of learned counsel for the petitioner is that he is in judicial custody since 20.03.2018 and other coaccused person having similar allegation has already been granted bail by a Coordinate Bench of this Court vide order
Patna High Court Cr.Misc. No.71523 of 2018(2) dt.10-12-2018 2/2 dated 20.09.2018 passed in Cr. Misc. No. 55182 of 2018. It has further been submitted that after this the petitioner has been remanded in one more case, which could not be mentioned in the petition.

Having heard both sides, in view of the above facts and as other co-accused person has already granted bail, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate Barh, Patna, in connection with Salimpur P.S. Case No. 71 of 2018, subject to the condition that one of the bailor must be close relative of the petitioner having sufficient property within the jurisdiction of the court concerned.
