The petitioner is apprehending his arrest in a case registered under Sections 109, 147, 149, 188 and 353 of the Indian Penal Code.

The prosecution allegation, in short, is that the accused persons forming an unlawful assembly were protesting and blocked the traffic on road and disrupted the communication. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is alleged to be one of the persons who was participating in the protest. Except for this, there is no other substantive evidence to suggest his implication in the

Patna High Court CR. MISC. No.81257 of 2019(2) dt.18-12-2019 2/2 present case. No specific overt act is alleged against the petitioner. General and omnibus allegation has been made against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R./complaint case. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Bodhgaya P.S.
