2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 331(4) and 305 of the BNS.
3. The case of the prosecution in short is that unknown miscreants has stolen golden ornaments worth Rs.49,000/-.
4. Learned counsel for the petitioner has submitted that the FIR was lodged against unknown miscreants. During course of investigation, one Mithu Kumar was apprehended and he has given his confessional statement. The name of this petitioner has surfaced in the confessional statement of Mithu Kumar. Learned counsel for the petitioner has further submitted
Patna High Court CR. MISC. No.83553 of 2025(2) dt.10-12-2025 2/2 that the petitioner has also given his confessional statement. Save and except the confessional statement there is nothing against the petitioner. Learned counsel for the petitioner has lastly submitted that the petitioner is a man of clean antecedent and is in judicial custody since 01.09.2025.
5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Town P.S. Case No. 806 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari.
