====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 23-12-2025 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Gopalpur Police Station Case No. 16 of 2025, disclosing offences under Section 30(a) of Bihar Prohibition and Excise Act.
3. The prosecution case, as per the First Information Report, is that, on 15.01.2025, at about 08:30 p:m, police on raiding duty, received a tip that petitioner was bringing liquor from UP via Sanhula. The police attempted to stop a motorcyclist, who fled after a car approached. Villagers identified the motorcyclist as Ajay Sah and the car occupant as the petitioner, Sandeep Kumar. On search of the four wheeler, bearing Registration No. BR01CC1942, total 42.105 litres of
Patna High Court CR. MISC. No.86421 of 2025(2) dt.23-12-2025 2/3 foreign liquor was recovered. Aadhaar Card, PAN Card and other documents related to petitioner, were also found in the car.
4. Learned Counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. The name of the petitioner has come on the identification made by local person. Petitioner has no concern with the seized Maruti Suzuki I-10 Car bearing Registration No. BR01CC1942 and neither was apprehended on the spot. Liquor has not been recovered from the conscious possession of the petitioner. Coaccused, namely, Ajay Kumar has already been granted bail by a Co-ordinate Bench of this Court vide order dated 02.09.2025, passed in Cr. Misc. No. 55911 of 2025.
5. Regards being had to the submissions made on behalf of the parties and taking into consideration the fact similarly situated co-accused person has been granted bail by a Co-ordinate Bench of this Court, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the

No.86421 of 2025(2) dt.23-12-2025 3/3 satisfaction of learned Additional District and Sessions JudgeIV-cum-Exclusive Special Excise Court No.-II, Gopalganj, in connection with Gopalpur Police Station Case No. 16 of 2025, subject to the condition laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita.
