This application for regular bail arises out of Phulwaria P.S. Case No. 152 of 2013, disclosing the offence under Section 498A of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

The petitioner is the husband of the informant. The informant was noticed by an order of this Court dated 29.11.2019. By the same order, the petitioner was allowed provisional bail.

Despite service of notice, there is no representation on behalf of the informant.

No.77867 of 2019(3) dt.06-03-2020 2/2 Learned counsel appearing on behalf of the petitioner has submitted that matrimonial dispute between the petitioner and the informant is the reason behind lodging of the First Information Report as can be seen from the contents of the First Information Report also.

Considering the facts and circumstances, particularly the fact that the petitioner has been allowed provisional bail by an order dated 29.11.2019 and there is no material to suggest any misuse of the said privilege, this application is allowed. The provisional bail granted to the petitioner by an order dated 29.11.2019 stands confirmed.
