The petitioner seeks pre-arrest bail in connection with Bakhtiyarpur P.S. Case No. 180 of 2019 registered under Sections 341, 323, 326, 307 and 34 of the Indian Penal Code and 27 of the Arms Act.

The accusation is that at about 07.00 p.m. on 11.05.2019 Chandan Kumar Rai, husband of the grand daughter of the informant, Ganesh Rai, was returning from Khagaria market, in the way he was shot fire, then, he came at the house of the informant in bleeding condition sustaining injury. On query, Chandan Kumar disclosed about causing fire arm injury by Gopal Yadav and Hitler Rai with allegation that Manish Kumar and Raman Kumar (petitioner) were also there. Submission is that it would appear from the first

No.78521 of 2019(2) dt.03-12-2019 2/2 information report itself that injured, Chandan Kumar, has specifically stated about causing fire arm injury by Hitler Rai and Gopal Yadav. He has only stated that petitioner (Raman Kumar) and Manish Kumar were also present with them. The petitioner has no criminal antecedent and is in custody since 19.07.2019.

Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Bakhtiyarpur P.S. Case No. 180 of 2019 to the satisfaction of the Chief Judicial Magistrate, Saharsa.
