2. The petitioner apprehends his arrest in connection with Banka P.S. Case No. 354 of 2025, registered for the offences punishable under Sections 191(2) 191(3), 190, 126(2), 115(2), 109(1), 303(2), 352, 329(4) of the BNS.
3. The allegation against the petitioner is of causing assault by means of farsa over the head of the informant leading to serious injuries, besides the allegation against other coaccused persons of causing assault to the informant and his wife.
4. Learned Advocate for the petitioner submitted that the present case is nothing but counter blast to Banka P.S. Case No. 347 of 2025, which was instituted by the brother of the
Patna High Court CR. MISC. No.84775 of 2025(2) dt.24-12-2025 2/3 petitioner against the informant and others. Moreover, with regard to an occurrence which took place on 09.08.2025, the present FIR came to be instituted on 13.08.2025 without there being any plausible explanation. So far the injury which is allegedly sustained to the informant is concerned, the same is simple in nature; to support the aforesaid contention, injury report has been placed on record as Annexure-P/2. The petitioner bears fair antecedent and he undertakes that he will fully cooperate in the proceeding of the court.
5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that the specific accusation has been levelled against the accused persons, with corresponding injuries and, as such, the complicity of the petitioner cannot be denied.
6. Regard being had to the submissions made on behalf of the parties and considering the nature of accusation qua the simple injury, besides the factum of case and counter case, which is on earlier point of time, as well as the fair antecedent of the petitioner, let the petitioner abovenamed be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail
Patna High Court CR. MISC. No.84775 of 2025(2) dt.24-12-2025 3/3 bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 354 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioner.
