The petitioner seeks anticipatory bail in connection with Sahebganj P.S.Case No.426 of 2019 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016 .

Allegation against the petitioner is about recovery of 02 ltrs. of liquor from the Fush House of the petitioner. Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case, having no criminal antecedent .

On the other hand the learned APP has opposed the prayer for bail on the ground of recovery from the house of the petitioner.

Patna High Court CR. MISC. No.85275 of 2019(2) dt.06-01-2020 2/2 Heard learned A.P.P. also.

Having heard both sides and in view of submission as made above, this application is disposed of with direction to the petitioner to surrender before the learned court below and pray for regular bail, which will be considered on its own merit without being prejudiced by the order of this Court, if possible to be disposed of on the same day.

With the aforesaid observation, this application is disposed of.
