2. This application has been filed for quashing the FIR of Gaighat P.S. Case No.285 of 2023, dated 25.07.2023, registered under Sections 147, 148, 149, 341, 323, 324, 307, 504, 504 of the Indian Penal Code and Section 25(1-b)a/26/35 of the Arms Act, wherein the petitioner along with others have been made accused are being prosecuted, and the case under investigation, and is pending in the Court of learned Judicial Magistrate, 1st Class, East Muzaffarpur.

3. There is recovery of one country made pistol from the possession of the petitioner.

4. This Court cannot consider the defence of the

Patna High Court CR. WJC No.17 of 2025(2) dt.30-06-2025 2/2 petitioner and quash the FIR. This application is dismissed.

5. If the petitioner is aggrieved by the final report of the police, he may approach the Court.
