2. The accused/petitioner is named in the F.I.R. and apprehended his arrest in connection with Darihat P.S. Case No. 90 of 2024 registered for the offences punishable under Section 126(2), 115(2), 132, 303(2), 352 and 3(5) of the BNS.

3. As per FIR, petitioner assaulted informant who is Junior Engineer, Dalmiya Nagar, while he visited the house of petitioner to install smart electric meter and during the course of occurrence golden chain and ring of informant were also snatched, as alleged.

4. Learned counsel appearing on behalf of the petitioner submitted that due to selection of place qua installation of electric meter some hot exchange of words took place between the petitioner and informant. It is submitted that allegation is

No.2456 of 2025(5) dt.06-01-2026 2/3 against petitioner and also against his brother as to assault on the head of informant by stone lying near to the place of occurrence but the injury report is not supporting the allegations. It is pointed out that informant was not examined medically and allegation of theft qua snatching of chain and ring was raised just to aggravate the allegation.

5. Arguing further, it is submitted that for the same set of occurrence the petitioner's side also lodged a case against informant, which has been registered as Darihat P.S. Case No. 91 of 2024. It is pointed out that subsequent to this case informant also alleged two cases against petitioner which have been registered as Darihat P.S. Case No. 92 of 2024 & Darihat P.S. Case No. 93 of 2024.

6. It is also pointed out that in aforesaid two subsequent cases lodged by informant, petitioner was granted privilege of Section 41-A of the Cr.P.C. and moreover matter is related with recovery of electronic dues.

7. Learned APP appearing on behalf of the State, opposes the prayer for anticipatory bail.

8. In view of the aforesaid facts and circumstances and by taking note of allegation of physical assault is appearing primafacie very much general and omnibus in nature for which case was

No.2456 of 2025(5) dt.06-01-2026 3/3 also lodged by petitioner's side, accordingly the petitioner above named, in the event of his arrest or surrender before the learned trial court within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Dehri/concerned trial court where the case is pending in connection with Darihat P.S. Case No. 90 of 2024 subject to the conditions as laid down under Section 438(2) of the Cr.P.C./ Section 482(2) of the BNSS. (Chandra Shekhar Jha, J.) S.Tripathi/- U T
