Learned counsel for the petitioner submits that during the pendency of the present writ application, final order has already been passed on 01.01.2021 in Confiscation Case No.46 of 2018 and the said order is appealable before District Magistrate-cum-Collector, Sasaram, as per the Section 52A of the Indian Forest Act, 1927. Learned counsel for the petitioner, therefore, submits that he may be permitted to withdraw this writ application with liberty to file an appeal before the District Magistrate-cum-Collector, Sasaram, against the final Confiscation order.
3. As prayed for, the writ application is disposed off
Patna High Court CWJC No.22832 of 2018(4) dt.15-07-2025 2/2 granting liberty to the petitioner to file an appeal against the order dated 01.01.2021, passed in Confiscation Case No.46 of 2018, in terms of Section 52A of the Indian Forest Act, 1927. If such an appeal is filed within a period of one month of passing of this order, it shall be considered and decided by the appellate authority, in accordance with law, with the aforesaid observation and direction, the present writ application is dismissed as withdrawn with the aforesaid liberty granted.
