2. The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 354(A), 34 of the Indian Penal Code and Section 8 of the POCSO Act.

3. As per the prosecution case, this petitioner, who is Principal of the school, is alleged to have molested the victim (niece of informant). It is further alleged that when the informant went to school to inquire the matter, this petitioner assaulted on the head of informant by means of rod.

4. It is submitted on behalf of petitioner that petitioner is innocent and has committed no offence. As a matter of fact, the informant and his associates forcibly entered into the school campus and thereafter, abused & assaulted petitioner & other

Patna High Court CR. MISC. No.2225 of 2024(2) dt.31-01-2024 2/2 staffs of the school, for which, an F.I.R., vide Deo P.S. Case No. 224 of 2023 was lodged against informant & others and only in order to take revenge, this false and concocted case has been lodged against this petitioner. Petitioner has got clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge 6th cum Exclusive Special Judge, POCSO Act, Aurangabad (Bihar) in connection with Deo P.S. Case No. 223 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
