Mr.Parmanand Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-02-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offence under Sections 191(2), 193(3), 126(2), 109, 352 of the Bhartiya Nyaya Sanhita and Section 27 of the Arms Act.

3. As per the prosecution case, on 31.08.2024 at about 7:45 AM, all the accused persons including petitioners came near informant and on the order of co-accused Mahendra Yadav, all accused started indiscriminate firing. It is further alleged that co-accused Sunil Yadav fired from his pistol, causing injury on the neck of informant.

4. Learned counsel for the petitioners submits that as per F.I.R. itself, specific accusation of firing is against coaccused Sunil Yadav. So far as these petitioners are concerned, though there is allegation of firing but no one has sustained any injury. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda in connection with Rahui P.S. Case No. 452 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
