This application for anticipatory bail arises out of Manjhi P.S Case No. 169 of 2018, disclosing offences under Sections 147, 341, 323, 324, 379, 506 and 504 of the Indian Penal Code.

Learned counsel, appearing on behalf of the petitioner, has taken me to the FIR to contends that there was a dispute between the parties over the passage and allegedly the persons named in the FIR gathered and assaulted the informant with Lathi, Danda, Farsa etc. The allegation against the petitioner is that he hit the informant on his forehead with a Farsa.

However, considering the background in which the

Patna High Court Cr.Misc. No.73031 of 2018(2) dt.18-12-2018 2/2 occurrence is said to have taken place and that the petitioner has no criminal antecedent, this application is allowed. Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned A.C.J.M. 2nd, Chapra (Saran) in Manjhi P.S. Case No. 169 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
