The petitioner in this case is seeking anticipatory bail in connection with Deepnagar P.S. Case No.236 of 2019 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 353, 337, 338, 224 and 225 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Learned counsel submits that there are general and omnibus allegations against this petitioner.

Learned APP for the State is present and has opposed the prayer for anticipatory bail of the petitioner.

No.80603 of 2019(2) dt.16-12-2019 2/3 Considering the facts and circumstances of the case wherein there are general and omnibus allegations against a large number of persons and a learned coordinate Bench of this Court has granted anticipatory bail to the co-accused in Cr.Misc.No.74426 of 2019 as also it appears from Annexure-2 to the present application that Commanding Officer, Headquarter Company of Army has certified that this petitioner being father of Mr.

Ranjan Kumar was in Pune with him in his duty station and was undergoing dental treatment at Command Hospital, Southern Command Pune and further contention of learned counsel for the petitioner that chowkidar has involved the petitioner out of local enmity, let the petitioner in the event of his arrest or surrender within a period of four weeks from today, be enlarged on bail on furnishing of bail bonds of Rs. 15,000/- (fifteen thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda, Biharsharif in connection with Deepnagar P.S. Case No.236 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. i.e.

(i) a condition that the person shall make himself available for interrogation by a police officer as and when required;
