JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-12-2019 The petitioners seek bail in connection with Adapur P.S. Case No. 194 of 2019, dated 12.08.2019, instituted for the offences under Sections 341, 323, 324, 307, 354, 504, 506, 379/34 and 302 of the Indian Penal Code. Though the petitioners have been named specifically in the F.I.R., but they are not alleged to have assaulted the deceased, viz., Almuddin Mian. The petitioners and others are said to have assaulted the informant and others.

It has been submitted on behalf of the petitioners

Patna High Court CR. MISC. No.79867 of 2019(2) dt.16-12-2019 2/2 that this case was lodged after a case on the informant and others was lodged at the instance of one Nayeem Hawari, whose father had been killed in an occurrence committed by the informant and others.

The petitioners are stated to be in custody since 16.08.2019 and 12.08.2019 respectively. They are persons of clean antecedents.

Regard being had to the facts that the petitioners are not assailants of the deceased and the existence of counter case in which the father of one of the accused persons of this case has lost his life, they are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Raxaul at Motihari in connection with Adapur P.S. Case No. 194 of 2019. The application stands allowed.
