Heard Mr. Y.C.Verma, learned senior counsel for the petitioner as well as Mr. Y.V.Giri, learned counsel for the informant and learned Additional Public Prosecutor for the State .
Petitioner seeks bail in a case registered in connection with Fatuha P.S.Case No. 56 og 2016 for the offences punishable under Sections 302, 307,427, 120B of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, on the alleged date of occurrence, all the accused persons variously armed with

No.74015 of 2018(13) dt.25-07-2022 2/3 surrounded the vehicle of the informant and one of the coaccused Munna Singh, made indiscriminate firing on the husband of the informant and thereupon the petitioner Sunil Rai and Subodh Rai also fired upon him due to which he died. It is also alleged that Subodh Rai fired on the sister -in-law of the informant which hit on her thigh and stomach.
Learned Sr. counsel appearing on behalf of the petitioner that the name of the petitioner has been implicated only on account of political rivalry and moreover, other co-accused persons namely, Subudh Rai has been granted bail by the court below itself and so far as the petitioner is concerned, he is in custody since 27.10.2016.
On the other hand, Mr. Y.V.Giri, learned senior counsel for the informant vehemently opposed the bail application of the petitioner and submits that petitioner is one of the main assailant causing death of the husband of the informant. It is also submitted that this petitioner is found involved in nine other serious nature of criminal cases. It is next submitted that the trial is at the fag-end and

Having heard the rival contentions of the parties and taking into consideration the final stage of the trial of the case and further the expectation and assurance of the learned trial court that the trial will be concluded within three months, this court is not persuaded to enlarge the petitioner on bail, hence his prayer for bail stands rejected. However, it is expected that the learned trial court will take all sincere efforts to concluded the trial within three months from today and if he fails to do so, the petitioner shall be at liberty to renew his prayer for bail.
