Petitioner is apprehending his arrest in connection with Mahindwara P.S.Case No.35 of 2019 , registered for offences punishable under Sections 30(), (b), (c), (f), 34, 36, 41 of the Bihar Excise Act.
As per FIR, police on information of manufacturing of liquor, raided the field of Md. Jubair and recovered some manufacturing articles . Petitioner was also named in the FIR, as the person who succeeded in fleeing away.
Submission of the learned counsel for the petitioner is that except the information supplied by the spy, thee is no other allegations against the petitioner, no recovery is from his possession or from his house or at his instance. He has no
Patna High Court CR. MISC. No.78748 of 2019(2) dt.03-12-2019 2/2 criminal antecedent and considering the same , this Court has granted anticipatory bail to one of the co-accused vide order dated 15.10.2019 passe din Cr. Misc. No.62194 of 2019. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below within a period of three weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the2019 like amount each to the satisfaction of the learned ADJ II cum Special Judge, Excise Act, Sitamarhi in connection with Mahindwara P.S.Case No.35 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
