2. The petitioner apprehends his arrest in Nanpur P.S. Case No. 349/2023 registered for the offences punishable under Sections 302, 120(B)/34 and 201 of the Indian Penal Code.

3. As per prosecution case, the informant alleged that his son went for walk after taking meal, but he did not return. Thereafter, his dead body was recovered. It is further alleged that the petitioners are indulged in hatching conspiracy to kill the informant's son in connivance with others.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that petitioner is son-in-law of the informant and has been falsely implicated in the present case on the basis of mere

Patna High Court CR. MISC. No.62 of 2024(4) dt.19-04-2024 2/2 suspicion. It is further submitted that similarly situated coaccused persons namely, Md. Murtuja, Md. Guljar and Md. Sahid Raja have been granted bail by this Court vide orders dated 23.01.2024 and 01.02.2024 passed in Cr. Misc. No. 3375 of 2024 and Cr. Misc. No. 3781 of 2024.

5. The application for bail is opposed by learned APP for the State as well as learned counsel for the informant .

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Nanpur P.S. Case No. 349/2023, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Puparee, District- Sitamarhi subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
