The petitioner seeks regular bail in connection with Special (Excise) Case No.461 of 2018 arising out of Nauhatta P.S.Case no.142 of 2018 dated 5.9.2018 registered for offences punishable under Sections 30(a, 38(1), 41(1) of the Bihar Prohibition and Excise Act, 2016 of the Indian Penal Code. Allegation as per FIR is that the police on secret information that a truck was parked with the huge quantity of liquor near the house of Sintu Thakur, raided the place and it is alleged that the petitioner is involved in supply of the illicit liquor.

Submission of the learned counsel for the petitioner is that no specific allegation has been attributed nor anything has

Patna High Court Cr.Misc. No.73901 of 2018(2) dt.14-12-2018 2/2 been recovered from the possession of the petitioner nor from the house of the petitioner. He has no criminal antecedent and he is in custody since 5.9.2018.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Sri Motish Kumar Singh, Special Judge (Excise Act), Saharsa in connection with Special (Excise) Case No.461 of2018 arising out of Nauhatta P.S.Case No1.42 of 2018.

With the aforesaid observation, this application is allowed.
