2. The petitioner is in custody since 05.08.2023 in connection with Bannubagicha P.S. Case No. 16/23 registered for the offence punishable under Sections 379 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is accused of stealing a motorcycle.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that the petitioner is not named in the F.I.R., his name cropped up during the course of investigation. It is also submitted that the petitioner is accused in Bannubagicha P.S. Case No. 22/2023 in which he has been granted bail.

5. Learned Additional Public Prosecutor appearing on

Patna High Court CR. MISC. No.3066 of 2024(2) dt.24-01-2024 2/2 behalf of the State has vehemently opposed the prayer for bail. He submits that the stolen motor cycle has been recovered in front of the house of the petitioner.

Considering the facts and circumstances of the case, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Bannubagicha P.S. Case No. 16/23.
