The petitioners are languishing in custody in a case registered for the offences punishable under Sections 401, 411, 120(B) of the Indian Penal Code and Sections 8, 20(b)(ii)(c), 25, 29 of the N.D.P.S Act. There is recovery of different gold and silver ornaments from the possession of the petitioners whereas from the possession of other co-accused persons, huge quantity of Ganja was recovered. It is submitted by learned counsel for the petitioners that petitioners are innocent and they have

Patna High Court CR. MISC. No.3739 of 2024(2) dt.31-01-2024 2/2 falsely been implicated in this case. The recovered articles belong to the petitioner. Nobody has claimed over the said articles. Moreover, the recovered articles were not put on T.I.P. There is no recovery of any contraband from the possession of the petitioners. The petitioners are languishing in custody since 10.08.2023. In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Samastipur in connection with Dalsingsarai P.S. Case No. 329 of 2023.
