JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 This application, for grant of anticipatory bail, arises out of Raxaul P.S. Case No. 224 of 2019, disclosing offences under Sections 420, 406, 407/34 of the Indian Penal Code. Petitioner happens to be owner of the truck, which was engaged by a transport company and F.I.R. further disclosed that the truck loaded with huge quantity of Palmolive Refine Oil proceeded to Gorakhpur, however, the truck became traceless and later on the same was recovered at the instance of husband of the petitioner.
Submission of learned counsel for the petitioner is that petitioner is only owner of the truck and the dealing was made by her husband, who has already been arrested in connection with this case and she is ready to abide by any
Patna High Court CR. MISC. No.80469 of 2019(3) dt.20-01-2020 2/2 condition imposed on her.
Heard learned A.P.P. also.
Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Raxaul P.S. Case No. 224 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure with further subject to the condition that petitioner shall cooperate in investigation and appear before the Investigating Officer as and when required.
