This is the second attempt on behalf of the petitioner for grant of bail in connection with Barachatti P.S. Case No.171 of 2023 registered for the offence punishable under section 302 of the Indian Penal Code. Earlier, the prayer of the petitioner for grant of bail has been rejected vide order dated 08.11.2023 passed in Criminal Miscellaneous No.59686 of 2023.

The petitioner is alleged to have taken the deceased on a motorcycle and has killed the deceased. 4.

The petitioner is in custody since 14.02.2023 5.

From the report of the trial court, it appears that not even a single witness has been examined in this case.

Considering the delay in the trial as well as the period of custody of the petitioner, this bail application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Sherghati, Gaya, in connection with Barachatti P.S. Case No.171 of 2023, subject to the condition that the bailors should be the blood relatives of the petitioner and the petitioner will cooperate in the trial and will appear through his advocate or himself on the dates fixed in the trial.
