====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 06-03-2020 Heard learned counsel for the petitioner, the informant and the learned A.P.P. for the State.
The petitioner apprehends her arrest in connection with Hilsa P.S. Case No. 405 of 2019 registered for the offences punishable under Sections 302/34 of the Indian Penal Code. The accusation is that Sajjan Kumar, the son of the informant,w ho was Indira Awas Sahayak, before one month, on his transfer, had come from Chandi Block to Hilsa Block. On being asked by the family members of his sasural, on 05.08.2019, the son of the informant had taken the house on rent beside Hilsa Mandal Jail and he used to reside with the family members of his sasural including the accused persons. No.77863 of 2019(3) dt.06-03-2020 2/3 the informant was not ready to reside at the rented house but on the pressure of his wife, he had taken the rented house and started to live there. On 08.08.2019, the informant rweceived information about t he illness of his son on mobile phone and was also informed that his son is admitted at the Hilsa Hospital. When the informant along with others reached there, he came to know that his son has died.
Learned counsel for the petitioner submits that the petitioner is wife of the deceased. There is no specific allegation against the petitioner. Learned counsel for the petitioner submits that the witnesses have stated during investigation before the Investigating Officer that the dead body of the deceased was in hanging condition in a room and said room was closed from inside as well as the doctor who performed the autopsy upon the dead body of deceased, opined that the cause of death is asphyxia due to hanging. He further submits that the Supervising Officer found this case true only under Sections 306, 120(B)/34 of I.P.C. Learned counsel for the petitioner further submits that the inlaws have been granted anticipatory bail vide order dated 04.02.2020 passed in Cr. Misc. No.74345 of 2019.

No.77863 of 2019(3) dt.06-03-2020 3/3 above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Hilsa under Nalanda Judgeship at Biharsarif in connection with Hilsa P.S. Case No. 405 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
