1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Konch Police Station Case No. 198 of 2024, dated 17.05.2024, disclosing offence punishable under Sections 366-A of the Indian Penal Code.

3. The prosecution case, as per the First Information Report, is that on 16.05.2024, at about 02 AM, the minor sister of the informant, aged about 17 years, left her home and upon enquiry, it has come that the petitioner has enticed and abducted the minor sister of the informant for the purpose of marriage.

4. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of the fact that the victim girl was having love relationship with the petitioner, which was not to the

The statement of the victim girl has been recorded under Section 164 of the Code of Criminal Procedure, 1973, in which she has disclosed her aged as 18 years and in the medical examination also, the age of the victim girl has been disclosed as 19 years. The victim girl, in her statement under Section 164 of the Code of Criminal Procedure, 1973, has stated that she was having love with the petitioner and both have solemnized marriage in a temple.

5. Regards being had to the submissions advanced on behalf of the parties and taking into consideration the statement of the victim girl recorded under Section 164 of the Code of Criminal Procedure, 1973, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gaya, in connection with
