The petitioner apprehends his arrest in a case registered under Section 420/379 of the Indian Penal Code. Allegedly, Rs. 1,00,000/- (one lakh) and other belongings of the informant were looted away by the accused persons. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been falsely implicated in the present case. The alleged occurrence is said to have taken place on 10-04-2019 whereas the FIR has been instituted on 21-04-2019. The delay has not been explained by the prosecution. The name of the

The genuineness and identification of the local residents has not been disclosed by prosecution. The prosecution has not come with clean hands. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest or surrender in the court below within six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Muffasil P.S. Case No. 174 of 2019 subject to conditions as laid down under Section 438(2) of the Cr.P.C..
