The petitioners seek regular bail in Aurangabad (Town) P.S.Case No.228 of 2018 registered under Section 379

Patna High Court Cr.Misc. No.71247 of 2018(2) dt.03-12-2018 2/3 of the I.P.C.

Accusation is that the informant after withdrawing Rs.3,25,000/- from the Punjab National Bank, Aurangabad, put his bag containing the said cash, Pass Book, Chequ Book, PAN Card and Adhar Card in the back seat of the vehicle and in the way when he parked his car near Old G.T.Road Pandey Pustakalay and went to the market in course of which some miscreants took out his bag after breaking glass of window of the car. On query the person present there did not give reply satisfactorily. But after viewing C.C.T.V. Camera the informant found two men after breaking the glass, stealing the aforesaid bag and fled away.

Learned counsel for the petitioners submits that the petitioners are not named in the F.I.R. In course of investigation the police apprehended the petitioners and got their statements recorded showing their hands. Nothing has been recovered from their possession nor they have been put on T.I.P. They are in custody since 25.08.2018 having no criminal antecedent. Charge sheet has already been submitted.

Learned A.P.P. also opposed the prayer for bail of the petitioner.

Considering the facts and circumstances of the case,

No.71247 of 2018(2) dt.03-12-2018 3/3 let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of C.J.M., Aurangabad, in Aurangabad(Town) P.S.Case No.228/18 subject to the condition that one surety must be parent of the petitioners.
