2. Petitioner seeks regular bail in connection with Muzaffarpur Rail P. S. Case No. 307 of 2023 in a case registered for the offences punishable under Sections 401/414 of the Indian Penal Code and Section 22(a) of the Narcotic Drugs and Psychotropic Substances Act.

3. As per the prosecution case, 13 Ativan 2 mg, Lorazepam Tablets 1.P.2 mg, a piece of blade, 70 rupees cash and two mobile phones were from the possession of the petitioner.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case only on

Patna High Court CR. MISC. No.86373 of 2023(4) dt.21-03-2024 2/2 suspicion. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 05.09.2023.

5. Learned A.P.P. for the State vehemently opposed the bail application and submitted that petitioner has got four criminal antecedents out of which one is of similar nature.

6. Considering the nature of accusation and criminal antecedents, prayer for bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Navya/- U T
