====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 10-12-2018 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Masarakh P.S. Case No. 211 of 2018 instituted for the offence under Sections 413 and 414 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner has been arrested merely on suspicion.

It is alleged in the written report that police went in Dumarsan market on getting information that one co-accused of Mashrakh P.S. Case No. 153 of 2018 is moving there. On seeing the police party one accused tried to run away by leaving his Motorcycle. On chase, he was apprehended by the police. He disclosed his name as Raju Kumar @ Vishal (petitioner).

Patna High Court Cr.Misc. No.73049 of 2018(2) dt.10-12-2018 2/2 The seizure list has been prepared which is part of First Information Report. The seizure list does not show any recovery of Motorcycle from possession of the petitioner. Petitioner is not named in Mashrakh P.S. Case No. 153 of 2018.

Petitioner is said to be in custody since 28.6.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Saran at Chapra, in connection with Masarakh P.S. Case No. 211 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
