Ms. Anita Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 16-12-2019 Heard the learned counsel for the petitioner and the learned APP for the State.
The petitioner apprehends his arrest in connection with Kesariya P.S. Case No. 123 of 2019 for the offence punishable under Sections 304(B), 201 and 120(B) of the Indian Penal Code.
The allegation against the petitioner is regarding him having conspired with the accused persons and killed the daughter of the informant, who happens to be the wife of the petitioner.
The learned counsel for the petitioner has submitted that the petitioner is innocent and has got a clean antecedent, hence he should be granted the privilege of anticipatory bail. I have heard the learned counsel for the petitioner and
Patna High Court CR. MISC. No.82093 of 2019(3) dt.16-12-2019 2/2 I find that the petitioner, being the husband of the deceased victim lady, is the main accused in the present case and the impugned order dated 17.10.2019 would bear it out that the prosecution witnesses have supported the case of the prosecution, as is apparent from the case diary. Having considered the facts and circumstances of the case and for the reasons mentioned herein above, I do not find any merit in the present petition, hence the same stands dismissed.
