JUSTICE MOHIT KUMAR SHAH ORAL ORDER 15-02-2024 The present writ petition has been filed seeking the following reliefs:- "1. For issuance of a writ in the nature of Mandamus or any other appropriate writ, for directing upon the respondent authorities to grant 1st and 2nd Assured Career Progression (hereinafter referred as 'ACP') to the petitioner from the date of 30.12.2003 and 30.12.2015 respectively as the petitioner has served upon more than 27 years in
2/4 Department of Revenue and Land Reforms, Government of Bihar, whereas the petitioner initially joined as a Circle Inspector (C.L.) on 30.12.1991 and retired from the service on 28.02.2019 from the post of Circle Officer, Runisaidpur, Sitamarhi.
(ii) For issuance of order, direction or writ of Mandamus or any other appropriate writ for directing upon the respondent authorities to modify/rectify the pay scale i.e.
from PB2+4800 to PB2 5400 after granting 2nd ACP i.e. from the date of 13.07.2016 to the petitioner whereby and whereunder the petitioner's pay scale was wrongly fixed by the respondent as the petitioner should be granted pay scale PB2+5400 on the place of PB2+4800 as one of the retired Circle Officer of same batch i.e. Shri Rajendra Pathak (SI.No.13) has been granted PB2+5400/- pay scale by the office order no. 03/2019 dated 20.11.2019, issued by the Department of Revenue and Land Reform, Government of Bihar.
3/4 (iii) For issuance of writ of in the nature of Mandamus for directing upon the respondent authorities to grant/pay the entire consequential benefit after granting 1st and 2nd ACP to the petitioner and also after modifying the pay scale after 2nd ACP."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Additional Chief Secretary, Department of Revenue & Land Reforms, Government of Bihar, Patna i.e. the respondent no. 2 for redressal of his aforesaid grievances. Liberty, so sought, is granted.

It is needless to state that in case the petitioner approaches the Additional Chief Secretary, Department of Revenue & Land Reforms, Government of Bihar, Patna i.e. the respondent no. 2, by filing appropriate representation, within a period of two weeks from today, the same shall be disposed off by a reasoned and a speaking order, in accordance with law, within a period of six
4/4 weeks, thereafter.

The writ petition stands disposed off on the aforesaid terms.
