JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-07-2024 The present writ petition has been filed seeking the following relief:- "1.(I) For Issuance of an appropriate writ in the nature of Mandamus commanding and directing the respondent to remove the encroachment from MauzaBariyarpur, Thana No.77, Plot No. 2461, as there is public road on Mauza Bariyarpur Thana No.77, Plot no. 2463, 2464, 2465, 2444,2443, 2442, 2439, 2461, 2449 & 2453 from last hundred years but respondent no.7 has

Patna High Court CWJC No.160 of 2024(3) dt.04-07-2024 2/2 encroached the part of the plot no. 2461 i.e. road and creating hindrance for general people, particularly when respondent no.7 has already lost Cri.

Revision No. 131/1998 arising out of Miscellaneous Case No. 319 (M)/96 u/s 147 of Cr.P.C. on 23.3.98 and thereafter this order has not challenged before any court of law."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to approach the Circle Officer, Khodabandpur, District-Begusarai, for redressal of his aforesaid grievances. Liberty, so sought, is granted.

Accordingly, the present writ petition stands disposed off.
