2. The petitioner seeks regular bail in connection with Allauli P.S. Case No. 16 of 2023, dated 20.01.2023, lodged under Section 392 of the I.P.C.

3. As per the prosecution case, the F.I.R. has been lodged against four unknown criminals. The four unknown criminals looted one mobile and Rs. 5,000/- from the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 17.08.2023 having clean antecedent. He further submits that the petitioner has not been put on T.I.P. and there has been no recovery from him. He further submits that the name of the petitioner has figured in this

Patna High Court CR. MISC. No.1694 of 2024(2) dt.18-01-2024 2/2 case by the confessional stated of the co-accused. He further submits that the similarly situated co-accused persons have been granted bail by the Co-ordinate Bench of this Court.

5. Learned A.P.P. for the State opposes the prayer for bail.

6. Considering the facts and circumstances of the case, this bail application is allowed.

7. Let the petitioner above named, be granted bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- 4th, Khagaria in connection with Allauli P.S. Case No. 16 of 2023, subject to the condition that the petitioner will mark his attendance at the Allauli Police Station, District- Khagaria in each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
