2. The petitioner is apprehending her arrest in connection with Siwan Mufassil P.S. Case No. 185 of 2023 dated 13.04.2023 registered for the offences punishable under Sections 498A, 304B/34 of the I.P.C. and Section 3⁄4 of the D.P. Act.
3. As per the prosecution case, the petitioner and other co-accused persons are alleged to have tortured and murdered the informant's daughter due to non-fulfillment of demand of Rs. 3,00,000/- as a dowry.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.89038 of 2024(2) dt.18-04-2025 2/3 that the petitioner is innocent and have been falsely implicated in this case. The petitioner has not tortured the informant's daughter. It is submitted that the petitioner is the mother-in-law of the deceased. There is general and omnibus allegation against the petitioner. The petitioner has no concern with the alleged offence. Similarly situated coaccused has already been granted bail by this court vide order dated 03.01.2024 passed in Cr. Misc. No. 77069 of 2023. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail application.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the allegation being general and omnibus, let the above named petitioners, in the event of her arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court concerned, Siwan in connection with Siwan Mufassil P.S. Case No. 185 of 2023, subject to the condition
Patna High Court CR. MISC. No.89038 of 2024(2) dt.18-04-2025 3/3 as laid down under Section 438(2) of the Code of Criminal Procedure.
7. The application stands allowed.
