2. The petitioner is in custody in connection with Samastipur (M) P.S Case No. 294 of 2023 registered for the offences punishable under Sections 399, 402, 411 and 414 of the Indian Penal Code, Section 8/20(b), 11B of the Bihar NDPS Act and Sections 25(1-B)a, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that petitioner is in custody since 10.06.2023 and earlier the bail application of the petitioner was rejected vide order dated 19.04.2024 with liberty that if the trial is not concluded within one year then the petitioner is at liberty to renew his prayer for bail. Now one year has been lapsed and the Trial is still not

Patna High Court CR. MISC. No. 87449 of 2025(3) dt.19-12-2025 2/3 concluded. He further submits that other co accused has been granted bail vide Cr. Misc. No. 73299 of 2023, vide Cr. Misc. No. 38718 of 2025 and vide Cr. Misc. No. 8255 of 2024.

3. On perusal of materials available on record and the submissions made on behalf of the learned counsel for the petitioner and considering the fact that other co-accused has been granted bail by the co-ordinate Bench of this Court, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of District and Additional Sessions Judge, Samastipur in connection with Samastipur Muffasil P.S. Case No. 294 of 2023 subject to condition :

• One of the bailor should be the family member of the petitioner who shall provide official document to show his/her bonafide.

• The petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his/her bail bond by the Trial Court itself;

• The petitioner shall appear before the concerned police station every fortnight for next six months to mark

• The petitioner shall in no way try to induce or promise or threat the witnesses of tamper with the evidences, failing which the state shall be at liberty to take steps for cancellation of his bail bonds;
