Heard learned APP as well as gone through the lower court record.
At an earlier occasion while rejecting prayer for bail vide order dated 10.04.2019 under Cr. Misc. No. 23026/2019 (Annexure-1), it has been observed, " the petitioner will be at liberty to renew the prayer for bail after six months in the event no substantive progress made in trial".
Report from the lower court in pursuance of order dated 13.01.2020 is available wherefrom, it is evident that charge-sheet against Dilip Rai and Kanchan Rai has been submitted keeping investigation pending against remaining three accused followed with order of cognizance.
Patna High Court CR. MISC. No.78477 of 2019(5) dt.12-05-2020 2/2 Petitioner is under custody since 07.03.2019 having no criminal antecedents as disclosed under para-3 of the petition.
Consequent thereupon, petitioner, Dilip Rai is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 9th Additional Sessions Judge, Saran in connection with Taraiya PS Case No. 61/2019.
