2. Petitioners apprehends arrest in a case registered for the offence punishable under sections 302 and 34 of the Indian Penal Code .
3. As per the prosecution case , the allegation against these petitioners is that they along with other co-accused persons killed the daughter of the informant by strangulating her with the help of rope .
4. Learned counsel for the petitioners submits that petitioner No. 1 is cousin Gotani, petitioner No. 2 is unmarried
Patna High Court CR. MISC. No.10153 of 2024(4) dt.24-07-2024 2/2 Nanad and petitioner No. 3 is cousin Gotani of the deceased. There is no specific allegation alleged against them. Informant is not the eye witness to the alleged occurrence . Only on the basis of suspicion they have been made accused in this case . Petitioners claim clean antecedent.
5. Learned counsel for the State opposed the prayer for bail and submitted that these petitioners are named in the F.I.R., and there is specific allegation against these petitioners that they along with other co-accused persons killed the daughter of the informant by strangulation . Postmortem report also shows that cause of death is asphyxia .
6. Considering the nature of accusation and gravity of offence , prayer for pre-arrest bail of the petitioners is rejected. (Prabhat Kumar Singh, J) Koushik/- U T
