Petitioner seeks bail in Revilganj P.S. Case No.258 of 2019 registered under Section 302 of the IPC. The informant lodged the case against unknown stating in his fardbeyan that his son had gone along with his friend to see the ailing father of Jitendra Kumar but his son did not return. On the next day, the dead body of the son of the informant was recovered.

Learned counsel for the informant in his further statement in para 21 of the case diary disclosed the name of the petitioner that his son went to see Anurag and he came to know that Anurag killed his son at the instance of the petitioner. It is further submitted that similar statement is made by other

Patna High Court CR. MISC. No.77999 of 2019(3) dt.19-03-2020 2/2 witness but there is no eye witness of the occurrence. Save and except suspicion, the Investigating Officer has not collected any tangible material against the petitioner.

Learned APP did not dispute the fact.

Having considered the facts aforesaid, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned C.J.M.
