2. The petitioners seek bail in anticipation of their arrest in connection with Banka PS Case No. 516 of 2023 dated 27.07.2023 registered for the offences punishable under Sections 341, 323, 504, 379/34 of the Indian Penal Code.
3. The learned counsel for the petitioners submits that the petitioners are persons with clean antecedents and the petitioner no. 2 is a woman and the informant alleges that the petitioners came to his shop and started abusing on which the informant objected, when they said that they are not abusing him and thereafter, they assaulted and took out Rs. 5000/- from his shop. The learned counsel next submits that petitioners have falsely been implicated in the present case. It is next submitted
Patna High Court CR. MISC. No.3257 of 2024(2) dt.12-02-2024 2/2 that petitioner no.2 had earlier filed Banka PS Case No. 521/2023 against the present informant. As such, the present false case claims to be instituted against the petitioners with general and omnibus allegations.
4. Learned A.P.P. opposes the submissions made by the learned counsel for the petitioners.
5. Considering the submissions made by the learned counsel for the petitioners the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Banka PS Case No. 516 of 2023 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
6. The application stands allowed.
