2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 137(2) and 140(3) of the B.N.S.S..

3. As per prosecution case, on the alleged date and time of occurrence, this petitioner kidnapped daughter of informant for the purpose of marriage.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Rather, petitioner has falsely been implicated in this case with ulterior motive only with a view to put pressure upon him. Admittedly, the alleged victim girl is a major and she was in love with this petitioner and both of them

Patna High Court CR. MISC. No.87948 of 2024(2) dt.20-01-2025 2/2 went to Banaras on their own accord and got married in Sri Sri 1008 Sarangnath Prachin Shiv Mandir, Sarnath, Varanasi on 05.08.2024 and both of them are now living together as husband and wife.

5. In this case, the victim has appeared through counsel and has stated that she has willingly married with this petitioner and both of them are living together as husband and wife.

6. Considering the aforesaid facts and circumstances, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Patna City, District- Patna, in connection with Didarganj P.S. Case No. 278 of 2024, subject to condition as laid down under Section 482 of the B.N.S.S..
