JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Patepur P.S. Case No. 12 of 2017 registered for the offence punishable under Section 392 of the Indian Penal Code. The first information report has been lodged against unknown persons but subsequently, one co-accused Md. Ishteyak Ahmad @ Chhotu Khan was arrested and confessed his guilt disclosing the involvement of the petitioner in the alleged crime. The investigation against the petitioner is still pending. Therefore, considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to extend the privilege of anticipatory bail to petitioner

Patna High Court Cr.Misc. No.73290 of 2018(2) dt.20-12-2018 2/2 and accordingly, his prayer for anticipatory bail stands rejected. However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
