2. In the present case, the petitioner seeks bail in connection with Buxar Industrial P.S. Case No. 200 of 2024, registered for the alleged offence under Sections 25(1-b) (a)/26/35 of the Arms Act.

3. As per prosecution case, at the instance of the petitioner and co-accused Shubham Rai, recovery of a pistol without magazine was made.

4. The learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. Nothing incriminating has been recovered from the person/possession of the petitioner. The recovery has been

The learned counsel further submits that the petitioner has been remanded in this case on 20.09.2024 and the charge sheet has been submitted. The petitioner is having criminal antecedent of eight cases, out of which, he is on bail in six cases.

5. The learned APP opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances of the case and submissions made hereinabove and considering the period of custody of the petitioner along with submission of charge sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Buxar Industrial P.S. Case No. 200 of 2024, subject to the conditions mentioned in Section 437(3) of the Code of Criminal Procedure and also the following conditions : (i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.
